Doubt whether Philip Halsmann’s case will ever come up for trial in the Innsbruck court was expressed by Attorney Pressburger, his defense counsel.
Mr. Pressburger stated that the court will probably throw out the case in view of the tremendous sympathy aroused throughout the country and the thin testimony on which the prosecution was based. In the event that the trial will be held, Mr. Pressburger stated that he will withdraw as Halsmann’s counsel since, although he left the Jewish faith before the World War, he is regarded in Innsbruck as a Jew. He feels that any anti-Semitic sentiments which are held against him might reflect on Halsmann’s possibilities for acquittal.
