The re-instatement of Dr. Herman Badt, Ministerial Director of the Prussian government, is expected to be one of the results of the verdict of the Leipzig Reichsgericht yesterday, the Jewish Telegraphic Agency was informed today.
The Reichsgericht ruled that the decree issued by President von Hindenburg appointing a Federal Commissioner and deputy commissioners is valid. At the same time it utered its opinion that the suspension of the Prussian government could be valid for a temporary period only and that even during this temporary suspension the Ministers could be barred from administrative acts only, leaving intact their rights to represent Prussia in the Federal Council, the Diet, etc.
Dr. Badt has been a member of the Federal Council for the past twelve years. An authority on the constitution, he also represented the Braun-Severing government before the Leipzig court in the matter of the ouster of the Prussian government.
The president of the Tribunal, Bumke, ruled that the dismissal of Dr. Badt was contrary to the constitution.
During the hearings on the unconstitutionality of the ouster of the Prussian government, Dr. Badt read an article by Paul Josef Goebbels, editor of “Der Angriff,” Nazi organ, with regard to “Jewish guilt” for Germany’s present situation. Dr. Badt offered the article as evidence that there is no justification to the charge of the Federal government that the Prussian Government treated the Nazi movement unfairly.
