Both the New York legislature and Governor Smith have used their efforts in an attempt to prevent the deportation of Sammy Goldman, who was declared by Ellis Island Immigration officials to be 3 per cent below normal in the intelligence tests.
Governor Smith today wired the President asking that he intervene in the case. A resolution asking that the boy be allowed to remain with his parents here was also passed by the State senate and lower house.
School teachers and physicians who have examined Sammy lately, according to Senator Fearson of Syracuse who is interesting himself in the case, have found the boy to be well above normal and attribute his failure to pass the Ellis Island tests to suffering from starvation and torture in Russia.
