Holds Temple Adjunct Free from City Tax

Exemption from city taxation was won in court yesterday by the Community House of the Congregation Emanu-El, the building of which adjoins the temple at Fifth avenue and Sixty-fifth street.

The efforts of the city to place the Community House under taxation failed when the Appellate Division yesterday unanimously affirmed a decision of Supreme Court Justice Collins, ruling that the Community House of the Emanu-El Congregation is entitled to be exempted from city taxation. James Marshall was the counsel for the temple.

The decision of the higher court creates an important precedent, Mr. Marshall declared. Religious and charitable institutions whose buildings have long enjoyed exemption and which the city is now seeking to place under tax will definitely benefit by this decision, Mr. Marshall explained.
