The Hudson County Grand Jury has returned an indictment against the Rev. Francis Gross of Perth Amboy on the charge of criminal libel, it was revealed today. Mr. Gross is being sought under a warrant for his arrest issued here Tuesday, and will be tried during the latter part of the month.
According to J. George Fredman, counsel for Samuel Untermyer, who started action against Gross for libel contained in anti-Jewish pamphlets circulated in the mails, until Gross is apprehended he is classified as a fugitive from justice.
Mr. Untermyer will cross-examine Gross when the latter comes to trial in order to determine whether the clergyman who has not been connected with a parish for several years is an agent of the Nazis.
The statements published by Gross defamed the Jewish people and scourged Mr. Untermyer and other officials. One of the pamphlets held up the Jews to ridicule and pleaded for widespread mobilization of anti-Semitic forces.
