A Milan rabbi today escaped a possible fine or jail term for refusing to take an oath in court here when the court dismissed him as a witness because his evidence was ruled “not fundamentally important to the trial.”

Rabbi David Treitel explained his refusal with the statement that as a Jew, “my faith forbids me to take the oath.” If the court had considered his evidence essential, his refusal could have resulted in a six-month jail sentence or a fine of $75 under the Italian Penal Code.
