Frankfurt court officials said today that a third court hearing will be held to end a dispute over sales of an American-made phonograph record containing Nazi songs and speeches. No date was set for the third hearing.
The record was declared in violation of the constitution last May by a lower court after a brisk sale. Copies were confiscated by the Frankfurt public prosecutor’s office. However, early this month, a Frankfurt Appeals court reversed the lower court and ruled that the contents of “Songs and Speeches of Nazi Germany” were not illegal.
The Frankfurt prosecutor’s office said that the issue would be taken to the federal court in Karlsruhe, the highest in West Germany. The appeals court rejected a request of the Frankfurt prosecutor that the confiscations be made permanent but pending the highest court ruling, the prosecutor can continue to confiscate any additional copies placed on sale.
