Philip Auerbach, former head of the Bavarian State Restitution Office, has been released from custody following the collapse of fraud charges brought against him in the State court here and the suspension of his trial. The court ruled that in view of developments at the trial, at which the prosecution failed to substantiate any of the charges against Auerbach, there were no grounds for continuing to hold him in custody. Auerbach, who for some time before the opening of his trial was confined to a hospital under police guard, is remaining in a hospital here, but is no longer in custody.
