The Jerusalem Chief Justice today dismissed a plea by Polish-born Haim Novik that his conviction by a Polish court-martial on charges of desertion be declared invalid on the grounds that he was not subject to the jurisdiction of the Polish military authorities.
Novik, who received a sentence of six years, claimed that he had volunteered for the Polish forces while in Russia as a refugee, but had been rejected. The Polish authorities, however, alleged that Novik had enlisted in the Polish Army in Russia and was evacuated when the units were moved to the Middle East in 1942.
