Dr. Marbach, the president of the highest financial court of Schieswig-Holstein, will be suspended on charges of perjury, a spokesman for the government said today.
Dr. Marbach was accused of giving false testimony in 1958 in the trial of Dr. Maximilian Mertens who was sentenced to 25 years in prison by a Greek court for participation in the deportation of Greek Jews to Nazi death camps. Dr. Marbach testified that while he was an administrative official in the German occupation army in Greece in 1942, no acts of violence had been committed against the Greek population.
Two judges have been suspended from the Schleswig-Hoistain state Social Court for hiding the identity of Professor Werner Heyde, who has been charged with being the head of the Nazi “mercy killing” program, official sources disclosed today. The president of the court had been suspended earlier this month for the same reason.
Dr. Heyde, who was arrested last month, had been employed under a false name as medical examiner for the court. He is accused of having had top responsibility in the killing of 70,000 inmates a of German camps–including many Jews–during the second World War.
