With the death this morning of Chief Justice Edward C, Eioher, it appeared entirely likely that the eight-months-old mass sedition trial over which he presided in District Court here will be declared a mistrial.

Government prosecutors are prepared to start new proceedings immediately in such an event. it is learned from informed sources. The case was adjourned this afternoon until December 7, by Justice James Proctor.
