The Supreme Court today confirmed sentence of death passed Jan. 28 by the Haifa Criminal Assizes on Mordechai Schwartz, Jewish constable, who was convicted of fatally shooting an Arab policeman. The majority ruling asserted all the evidence needed for conviction of premeditated murder had been adduced. Justice Frumkin dissented, contending elements of premeditation, particularly cold-blooded preparation, were lacking. The defense announced it will appeal to the British Privy Council.
