William Dudley Pelley, anti-Semitic propagandist, today was faced with the choice of submitting to extradition to North Carolina, where he is wanted by the authorities for violation of the terms of a suspended sentence, or carrying his fight to the Supreme Court.
The U.S. Court of Appeals today upheld the decision of the District Supreme Court that North Carolinas demand for Pelley’s return was justified. The State court at Asheville over a year ago issued a capeas for Pelley’s return to answer charges that his Fascist activities had violated conditions under which a five-year sentence for violation of the State Securities Sales Law was suspended.
Pelley’s attorney, T. Edward O’Connell, was out of the city today and it could not be learned whether he intended to carry the appeal further.
About six months ago Pelley transferred his headquarters from Asheville to Indianapolis, where he resumed publication of his anti-Semitic weekly under the title, Roll Call. Despite previous protestations of lack of financial resources, Pelley apparently had no difficulty in raising a $10,000 down payment on a $40,000 printing plant in suburban Indianapolis, according to Dies committee agents.
