brothers were found guilty on nineteen counts and were sentenced to a total of seven months in jail and $7,425 in fines.

The defendants appealed the case to the Circuit Court of Appeals which ruled that the wage and hour provisions of the code were unconstitutional but sustained the lower court on the other counts. Immediately, the government seized upon this case as a clear test of the whole NRA and appealed to the Supreme Court to overrule the Circuit Court no those two counts. At the same time the Schechters appealed the other seventeen counts. The Supreme Court decision was a complete victory for the Schechters.
