Austrian Restitution Body Holds Illegal All Property Transfers by Jews During Nazi Rule

The Vienna Restitution Commission today rendered a decision in a teat case concerning Jewish property “legally” transferred during the Nazi regime which opens the door for wholesale return of all property sold and transferred by Jews under duress since the Anschluss of 1938.

The Commission ordered the return of the property on the basis that although the transaction was legal under the current Nazi laws the Jew who sold his property has acting under a pressing need to emigrate because of the Nazi persecutions.

In a second case, the Commission decided that all Jews were political persecutes because one of the announced political aims of the Nazi state vas the elimination of all Jews. This decision makes the Jews eligible for all forms of restitution and aid to persecutees because they can apply for redress either as racial or political persecutees.
