Chief Justice Wheat of District Court today ordered William D. Pelley returned to North Carolina in an extradition hearing to show cause why a suspended jail term should not be imposed against the anti-Semitic Silver Shirt leader.
Execution of the decision was delayed when T. Edward C’Connell, Pelley’s attorney, said he would seek a writ of habeas corpus. Pelley was remanded to the custody of the United Stated marshal pending the habeas corpus hearing and the setting of bond.
It will be many weeks before Pelley is returned to North Carolina, if at all. The habeas corpus hearing was set for March 20. Should the writ be refused, O’Connell will appeal to the District Court of Appeals of the District of Columbia. If that appeal fails he will take the case to the Supreme Court, he said.
