An effort to prevent Mayor-elect David A. Croll from taking office on January 1st failed when City Solicitor Bruce MacDonald handed down an opinion in his favor.
The effort against the newly elected Jewish mayor was made by Alderman Clyde W. Curry, a defeated candidate for mayor, on the ground that Mr. Croll was attorney for a number of Quelette Avenue property owners who appealed their assessments. This, it was charged, is a violation of the section of the municipal act which states that “any person, himself or by or through others, who is counsel for the prosecution of a claim against the city, is ineligible for city office.”
City Solicitor MacDonald ruled that a solicitor acting against the city would be barred under the Ontario law from elective office, but he added that he has been informed that Croll withdrew before nomination day and that he was not required to notify the city of his withdrawal.
