Magistrate David L. Malvin, sitting yesterday in the Homicide Court, 31 Snyder avenue, Brooklyn, denied a motion to dismiss the complaint against the Kosher Provision Co. and ordered the corporation and its president held for trial in the Court of Special Sessions. The defendant, Abraham Kaufman, president, was out on $500 bail.
Magistrate Malvin, commenting in his decision on the discovery of our barrels of non-kosher briskets and four barrels of tongues on the premises of the defendant, declares:
“It would be a mockery of the law to construe that meats held in storage under these circumstances did not violate Section 435-A of the Penal Law.”
He further declares that the defendants “were, by a well planned and deliberate scheme conspiring to perpetrate a fraud upon an unsuspecting and innocent class of citizenry.”
“Commerce and business in the preparation and sale of kosher products has reached such tremendous proportions and is of such great concern to a large mass of people that the propriety of such regulations and laws can no longer be questioned.”
