German Court Dismisses Case of Russian Emigre Anti-semites

The District Court here has dismissed appeals pressed by both prosecution and defense against fines imposed some months ago on two Russian emigre Jew-baiters, Eugene Arciuk and Vsevolod Mositchkin.

Arciuk is the leader and Mositchkin the secretary-general of RONDD, an extremist Fascist movement that is the spiritual descendant of the Tsarist “Black Hundreds.” Under a law existing only in Bavaria, they were convicted of having incited racial hatred in their magazine, “Nabat.” The publication, which features attacks on Jews, freemasons and President Eisenhower, gave over an entire issue to an inflammatory article on “The Jewish Question.” It is also distributed in German and English-language editions.

The judge refused to hear the appeal on the grounds that any penalty he might pronounce would fall under Germany’s recently-enacted amnesty. The prosecutor has filed a complaint against this decision with a higher court.
