Pelley Called Before Court in Carolina

William Dudley Pelley, commander of the Silver Shirts, anti-Semitic organization, together with two of his aides, have been ordered to appear before the clerk of the Superior Court of Buncombe County on April 25 in connection with receivership proceedings instituted against the Galahad Press, Inc., publishers of Liberation, weekly organ of the Silver Shirts.

Judge Michael Schenck, of the Superior Court, on Saturday signed an order appointing W. Bowen Henderson, Asheville accountant, as temporary receiver for the press.

A receiver was appointed after Deputy Sheriff John Garrison returned unsatisfied an execution secured by Charles G. Scott and Company of Washington, D. C. on a judgment against the concern.

Attached to the returned unsatisfied execution was an affidavit made and sworn to by the Deputy Sheriff that he talked with Robert Summerville, secretary and treasurer of the Galahad Press, and was told by Summerville that the company “has no property and does not even have a sheet of paper.”

The affidavit was sworn to and subscribed before John W. Hayes, Deputy Clerk of Buncombe County Superior Court. A bond of $500 has been posted by Henderson as receiver and all books, records and correspondence of the Galahad Press are now in possession of the receiver. Records turned over to Henderson include stock books, account books, bank check records and records of all receipts and disbursements of the Liberation Magazine.

The subscription lists of the magazine, all correspondence relating to the affairs of the Galahad Press or Liberation, and its records reveal that more than 200 persons in all sections of the country have stock in the press, In an order signed by Judge Schenck, Summerville, Pelley and Harry F. Sieber, business manager of the organization, are required to “appear before J. B. Cain, clerk of Buncombe County Superior Court, on the 25th day of April at ten o’clock and answer concerning any property or assets of said corporation and what disposition if any has been made of the money, assets of property coming in to said organization, and such other matters as may be pertinent to such supplemental proceedings.”

Pelley is said to be in California.
