Geoghan, who appeared personally, demanded that McLaughlin be held for trial in $1,000 bond, a figure on which the court agreed. No indictment was returned – against three other defendants in the case. They were the D-Z Publishing Corporation, Walter Kappe, editor of the German portion of the Deutsche Zeitung, and Carl Voelcker, president of the corporation and McLaughlin’s father-in-law.
According to the complaint, the Nazi newspaper, in its English supplement, printed an editorial last July 7 demanding the disbarment of former Magistrate Joseph Goldstein and accusing him of perjury while conducting the defense of three Jewish youths accused of a statutory offense.
Goldstein subsequently filed criminal charges and the case was heard in Magistrate’s Courts in July, August and September, when the defendants finally were held for the Grand Jury.
Although no date has been set for McLaughlin’s trial, Geoghan said yesterday it probably will take place late this month or early next month.
