Elmer J. Garner and his son James, publishers of the allegedly seditious, anti-Semitic weekly “Publicity,” were today awaiting trial on charges of sedition.
The Garners, who were indicted by a Federal grand jury here on Saturday, are accused of “acts tending to discourage the recruiting for the enlisted service of the United States and to cause insubordination, disloyalty and mutiny in the armed forces of the United States” S. S. Alexander, Federal District Attorney for Kansas, said the indictment grew out of articles published since the declaration of war by this country.
The indicted men had been mentioned recently as being among the group of allegedly subversive publishers on whom Attorney General Francis Biddle was preparing to “crack down.”
