The Lord Chancellor then declared. “This is like the practice in the army. where men of undefined beliefs are classed as Church of England members.”

Sir John described the educational position in Quebec. declaring that the appelants submit to the Privy Council that the Canadian courts had not properly understood the situation regarding the British North American Art. The appelants contend that nothing is contained in that act which affects the right and privilege to have denominational schools by any class of persons. The hearing was adjourned until Thursday.

The Protestant Board of School Commissioners, in whose schools Jewish children are educated. and on which the Jewish community is claiming representation. contend that the Act of the Quebec Legislaure passed in 1903 to give to Jews the same rights and privileges as Protestants in the matters of education was unconstitutional as invading the rights of Protestants to control their own educational system. This right was secured to them at Confederation. they claim. and the Quebec Act violates the provisions of the British North American Act.
