The first attempt to secure a judicial pronouncement on the content of the Julius Streicher anti-Semitic weekly, Der Stuermer, failed today when a court at Frankfort refused to consider the question.
The point came up on the demand of a person found guilty of offending Streicher, during an appeal to have the sentence set aside.
Other attempts to have a court rule against the publication are planned. Streicher, arch anti-Semite, is overlord of Franconia.
The sentence, one month in jail, was upheld.
