The United States Commissioner for Bavaria, Prof. Oron J. Hale, today ruled that the German court assigned to try Dr. Philip Auerbach, former Bavarian Commissioner for Restitution, is competent. Dr. Auerbach, who has been under arrest for a year, is charged with fraud in office.

Dr. Auerbach’s defense counsel had contended that the German court was incompetent to try the former Commissioner, since he was appointed by the U.S. military authorities. Investigation is still continuing of the charges that the German judges appointed to hear Dr. Auerbach’s case had once been members of the Nazi Party and high officials in Nazi legal institutions.
