The report circulated by the Voelkischer Beobachter, official Nazi organ in Germany, that the libel action against Col. Ulrich Fleischauer has been withdrawn, was officially denied here today.

The official statement declares that postponement of the trial, which was scheduled to open in Berne August 28, is due to the fact that new evidence has been entered and writs for a second action against Fleischauer have been filed. The new date for both actions will be set shortly.

The action against Col. Fleischauer was brought by Dr. Tobler of the Tobler candy firm following charges of perjury made by Fleischauer against Dr. Tobler in the famous “Protocols of Zion” case in Berne last Spring. Col. Fleischauer was an “expert” for the Nazis, and Dr. Tobler testified for the Jews.
