The Supreme Court of New South Wales dismissed today a libel action against Smith’s Weekly for $35,000 brought by the youth Aliyah. The action was based on publication by the weekly of an article entitled “Jews Raise funds to fight British.”

In dismissing the action, the presiding Judge expressed regret that Australian law did not recognize attacks against a class or section of the community, no matter how unwarranted, as actionable under the laws of libel. He suggested that Parliament reshape the law.
