Counsel for Philip Auerbach, deposed head of the Bavarian Restitution Office, has appealed to the German court trying Auerbach on charges of fraud in office for the release of the defendant. Counsel said that so many charges against Auerbach have been dropped that there is not sufficient evidence to warrant his detention.
Meanwhile, other attorneys for Auerbach have charged that Dr. Josef Mueller, Bavarian Justice Minister, sold indemnification credits worth 20,000 deutschemarks at a profit to himself. The charge is based on a deposition by Juda Weismann of Tel Aviv.
Meanwhile, it was revealed here today by the Bavarian Ministry of Finance that only 5,500,000 deutschemarks were paid out to victims of Nazism in Bavaria last year, despite the fact that 12,000,000 deutschemarks were made available for indemnification purposes. The Ministry said that this was due to a lack of “technical organization in the settlement of indemnification claims resulting from corruption at the Bavarian Restitution Office under Philip Auerbach.”
