Because a British soldier being tried for activities aiding the enemy objected to the presence on the military court of a Jewish officer, the latter was removed and replaced by a non-Jew, it was revoaled here today.

When Pvt. Theodore Schuerch was summoned before the court, he demanded to know the religion of each member. Upon learning that one major was a Jew, he asked that he be removed. Schuerch’s attorney said that since “the question of fascism looms large in the accused’s mind, there would be an inevitable clash between the accused and the major.” The court thereupon decided to replace the Jewish officer with a member of the Church of England.
